Mónica van der Schraft Moderates Panel on Good Faith and the Doctrine of Actos Propios at the IPA Congress
On April 29 and 30, the 20th edition of the Congress of the Peruvian Arbitration Institute (Instituto Peruano de Arbitraje - IPA) was held in Lima. This year’s edition stood out for the quality of its organization and the relevance of the topics addressed in light of recent developments in arbitration.
During the event, Mónica van der Schraft moderated a panel on good faith and the doctrine of actos propios, both of which are increasingly consolidated as standards of conduct with a decisive impact on dispute resolution. A brief review of recent arbitral awards confirms their growing importance.
The panel brought together complementary perspectives: Arif Ali addressed the evolution of the principle of good faith and its role in international law, particularly in investment matters; Edgardo Muñoz analyzed the impact of the applicable law on the scope of good faith, actos propios and estoppel; José Antonio Caínzos discussed their recognition as a codified general principle and their projection in administrative law; and Ernesto Benito examined their limits, particularly in relation to public policy and corruption.
